CONTENTBUSINESS.FI, HEALTHCAREBUSINESS.FI LEARNINGBUSINESS.FI JA SWBUSINESS.FI -PORTAALIEN KÄYTTÖEHDOT

1. Soveltaminen ja Portaalin käyttötarkoitus

Näitä ehtoja sovelletaan Culminatum Ltd Oy –Helsinki Region Centre of Expertisen (jäljempänä ”Culminatum”) www-osoitteissa, http://www.contentbusiness.fi, http://www.healthcarebusiness.fi, http://www.learningbusiness.fi ja http://www.swbusiness.fi olevien portaalien sisältöön ja niiden alaisten www-sivujen (jäljempänä yhdessä ”Portaali”) sisällön käyttöön. Portaalin käyttäjä (jäljempänä ”Käyttäjä”) hyväksyy nämä käyttöehdot sekä sitoutuu noudattamaan niitä käyttäessään tai muuten hyödyntäessään Portaalia.

Contentbusiness.fi -portaali on sisältöliiketoiminnan yritysten, healthcarebusiness.fi –portaali terveydenhuollon sekä hyvinvoinnin teknologian yritysten ja palveluntuottajien, learningbusiness.fi -portaali digitaalisten oppimispalvelujen yritysten ja swbusiness.fi -portaali ohjelmistotuoteyritysten sekä näiden klustereiden sidosryhmien kohtaamispaikka, tietopankki ja uutislähde ja ne on tarkoitettu käytettäviksi näihin aloihin liittyvissä tarkoituksissa. Portaalia saa käyttää vain edellä kuvatuissa tarkoituksissa. Portaalia tai näitä ehtoja koskevissa kysymyksissä tai ongelmissa Käyttäjä voi ottaa yhteyttä Culminatumiin sähköpostiosoitteella culminatum@culminatum.fi .

2. Portaaliin liittyvät immateriaalioikeudet

Kaikki Portaalissa olevat artikkelit, teokset ja muu aineisto ovat tekijänoikeuslailla suojattua aineistoa. Niiden kopioiminen, julkaiseminen ja muu hyödyntäminen ei-kaupallisiin tarkoituksiin on sallittua edellyttäen, että lähde mainitaan, mutta niiden kopioiminen ja siteeraaminen kaupallisiin tarkoituksiin on kiellettyä .

Portaalissa esiintyvät eri yritysten tuotteiden ja palveluiden nimet ja tunnusmerkit ovat ko. yritysten suojattuja tavaramerkkejä. Niiden käyttäminen on kiellettyä ilman asianomaisen yrityksen antamaa lupaa .

Portaalissa sijaitsevien ohjelmistojen immateriaalioikeudet kuuluvat Culminatumille tai sen lisenssinantajalle. Kyseisten ohjelmistojen osalta noudatetaan niiden yhteydessä olevia ko. ohjelmistoa koskevia lisenssiehtoja.

 

3. Portaalin käyttö

Rekisteröityessään Portaaliin Käyttäjä valitsee itselleen käyttäjätunnuksen ja salasanan. Salasana on henkilökohtainen ja Käyttäjä sitoutuu säilyttämään sitä huolellisesti ja olemaan paljastamatta sitä kolmannelle. Käyttäjä on vastuussa käyttäjätunnuksellaan ja salasanallaan tapahtuneesta Portaalin käytöstä.

Käyttäjät ja muut osapuolet (jäljempänä ”Sisällöntuottajat”) voivat toimittaa Portaaliin teoksia, tietoja ja muuta aineistoa tai sisältöä (jäljempänä yhdessä ”Aineisto”), jotta Portaalin käyttäjät saisivat mahdollisimman ajantasaista ja monipuolista aineistoa ja tietoa Portaalin kautta. Sisällöntuottajat vastaavat toimittamastaan Ainestosta. Culminatumilla ei ole mahdollisuutta tarkistaa Ainestoa ennakolta tai jälkikäteen. Culminatum pyrkii poistamaan Sisällöntuottajien toimittamasta Aineistosta lainvastaisen, loukkaavan, hyvän tavan vastaisen tai virheellisen sisällön heti, kun Culminatum saa tiedon tällaisen Aineiston olemassaolosta.

Portaalissa käytetään cookieita (evästeitä), joiden tarkoituksena on tarjota Käyttäjälle Portaalin nopeampi käyttö. Käyttäjä voi estää cookieiden käytön muuttamalla selaimensa asetuksia. Cookien käytön esto voi hidastaa Portaalin latautumista sekä estää käyttämästä tiettyjä osia Portaalia.

Culminatumilla on oikeus milloin tahansa tehdä muutoksia Portaalin ulkoasuun, rakenteeseen, Aineistoon ja muuhun sisältöön ilmoittamatta siitä etukäteen Sisällöntuottajille ja Käyttäjille sekä keskeyttää pääsy Portaaliin kokonaan tai osittain teknisistä syistä. Culminatum pyrkii ilmoittamaan keskeytyksistä etukäteen.

4. Sisällöntuottajan Portaaliin toimittama Aineisto

Sisällöntuottaja vakuuttaa ja sitoutuu siihen, että hän

• noudattaa näitä käyttöehtoja eikä käytä Portaalia lainvastaisiin tai hyvän tavan vastaisiin tarkoituksiin kuten ketjukirjeiden, viestien, sähköpostimassalähetysten (spamming) lähettämisiin tai muihin vastaaviin tarkoituksiin.
• ei käytä väärää henkilöllisyyttä tai sähköpostiosoitetta eikä muutoinkaan anna harhaanjohtavaa tietoa henkilöllisyydestään tai viestin alkuperästä.
• ei toimita Portaaliin Aineistoa varmistumatta siitä, että Aineisto ei sisällä tietokoneviruksia tai muita näihin rinnastettavia ohjelmistoja.
• ei toimita Portaaliin Aineistoa,
  • § joka ei vastaa näiden ehtojen kohdassa 1 mainittua Portaalin tarkoitusta;
  • § joka loukkaa kolmannen osapuolen tekijänoikeuksia tai muita immateriaalioikeuksia, tai
  • § joka loukkaa muutoin kolmannen osapuolen oikeutta tai on muutoin hyvän tavan vastainen, sisältää sopimatonta materiaalia taikka on muuten sisällöltään laiton, asiaton tai jotakin kohtaan loukkaava.
• ei pyri estämään tai vaikeuttamaan toisten käyttäjien Portaalin käyttöä.

Sisällöntuottaja luovuttaa Culminatumille Portaaliin toimittamaansa Aineistoa koskevan veloituksettoman ja ajallisesti rajoittamattoman käyttö-, esittämis-, kopiointi- ja edelleenluovutusoikeuden. Culminatumin käyttöoikeus sisältää myös oikeuden muunnella, kehittää ja kääntää Sisällöntuottajan toimittamaa Aineistoa sekä käyttää sitä edellä mainitun käyttöoikeuden puitteissa. Sisällöntuottajalla säilyy kuitenkin tekijänoikeus lähettämäänsä Aineistoon .

Culminatumilla on oikeus, mutta ei velvollisuutta, valvoa Portaalissa olevia Aineistoa. Culminatumilla on koska tahansa oikeus poistaa tai siirtää Portaalissa olevia Aineistoa taikka kommentoida sitä ilmoittamatta siitä Sisällöntuottajalle etukäteen, jos

• Culminatum katsoo sen olevan lain tai näiden käyttöehtojen vastaista taikka jos kolmas osapuoli esittää tällaisen väitteen;
• Culminatumilla on syytä epäillä, että Aineisto loukkaa muutoin kolmannen osapuolen oikeutta; tai
• Culminatum katsoo, että Aineisto on virheellistä, harhaanjohtavaa, vanhentunutta taikka hyvän tavan vastaista.

Culminatumilla on oikeus myös muutoin poistaa Sisällöntuottajan toimittamaa Aineistoa, kun sen toimittamisesta tai viimeisestä päivityksestä on kulunut neljätoista (14) kuukautta eikä Sisällöntuottajan Culminatumin huomautuksesta huolimatta ole sitä poistanut tai päivittänyt siitä erikseen ilmoittamatta. Sisällöntuottajan toimittamat sähköpostiviestit Culminatumilla on oikeus poistaa milloin tahansa siitä erikseen ilmoittamatta.

5. Linkit sähköisille kauppapaikoille ja muille www-sivuille ja niitä koskeva Culminatumin vastuunrajoitus

Portaalissa on linkkejä sähköisille kauppapaikoille ja muille www-sivuille (jäljempänä yhdessä ”Linkitetyt Sivut”). Käyttäjä on tietoinen siitä, etteivät tällaiset sivut ole Culminatumin ylläpitämiä ja ettei Culminatum tarkista aktiivisesti näiden sivujen sisältöä. Käyttäjä hyväksyy sen, ettei Culminatum vastaa Linkitetyillä Sivuilla olevista tiedoista, niiden sisällöstä eikä hyödykkeistä, joita näillä sivuilla tarjotaan .

Käyttäjä on tietoinen, että tilatessaan tuotteita tai palveluita Linkitetyiltä Sivuilta Käyttäjä tekee sopimuksen ko. sivujen ylläpitäjän kanssa. Käyttäjä hyväksyy sen, ettei Culminatum ole missään vastuussa Linkitetyillä Sivuilla tehdystä tilauksesta sekä ettei Culminatum ole muutoinkaan vastuussa Linkitettyjen Sivujen ylläpitäjän toiminnasta. Käyttäjän tulee kohdistaa mahdolliset tiedustelut, reklamaatiot ja vaatimuksensa, jotka koskevat Linkitetyltä Sivuilta tilaamaansa hyödykettä, suoraan ko. sivujen ylläpitäjään.

6. Henkilötietojen luovuttaminen

Käyttäjä antaa Culminatumille yksiselitteisen suostumuksen käsitellä Käyttäjän ilmoittamia henkilö- tai yritystietoja kyseessä olevien toimialojen toimialajulkaisuihin, suoramarkkinointiin, mielipide- ja markkinatutkimuksiin ja muuhun näihin rinnastettaviin osoitteellisiin lähetyksiin.

Culminatumilla on oikeus luovuttaa Käyttäjän henkilötietoja em. tarkoituksiin sekä Suomessa että kansainvälisesti, ellei Käyttäjä ole tätä kieltänyt rekisteröityessään Portaalin käyttäjäksi taikka myöhemmin asiaa koskevalla kirjallisella ilmoituksella.

Culminatumin Portaaliin liittyvä henkilötietolain 10 §:n mukainen rekisteriseloste on saatavissa ottamalla yhteys Culminatumiin: aila.blomberg@culminatum.fi.

7. Vastuunrajoitukset

Culminatum ei vastaa ylivoimaisesta esteestä aiheutuneista vahingoista. Culminatum ei myöskään vastaa Portaalin käytön keskeytymisestä tai muista käyttöä koskevista häiriöistä eikä Portaalin laadullisista ominaisuuksista tai soveltuvuudesta tiettyyn käyttötarkoitukseen.

Sen lisäksi, mitä muualla näissä ehdoissa on todettu Culminatumin vastuusta, Culminatum ei ole missään vastuussa Käyttäjälle tai Sisällöntuottajalle mahdollisesti aiheutuneista vahingoista. Missään tapauksessa Culminatum ei vastaa välillisistä vahingoista.

8. Portaalia koskevien käyttöehtojen voimassaolo ja niiden muuttaminen

Käyttöehdot ovat voimassa toistaiseksi. Culminatumilla on oikeus muuttaa käyttöehtoja milloin tahansa välittömin vaikutuksin ilmoittamalla muutoksesta Portaalissa tai lähettämällä asiaa koskeva ilmoitus Käyttäjän rekisteröitymisensä yhteydessä ilmoittamalla sähköpostiosoitteella. Käyttäjän katsotaan hyväksyneen muutokset, jos hän käyttää Portaalia muutosilmoituksen jälkeen.

Culminatumilla on oikeus välittömin vaikutuksin poistaa Käyttäjän käyttöoikeus ja pääsy Portaaliin, mikäli Käyttäjä rikkoo näitä käyttöehtoja.

9. Sovellettava laki ja erimielisyydet

Näihin käyttöehtoihin sovelletaan Suomen lakia. Näistä ehdoista aiheutuvat erimielisyydet ratkaistaan Espoon käräjäoikeudessa.

CONTENTBUSINESS.FI, LEARNINGBUSINESS.FI AND SWBUSINESS.FI -SITES; TERMS AND CONDITIONS (THE "TERMS OF USE")

1. Scope of Application of Terms of Use; Purpose of Site

These Terms of Use will be applied to the content of portals maintained by Culminatum Ltd Oy –Helsinki Region Centre of Expertise (hereinafter referred to as “Culminatum”) located at www-addresses http://www.contentbusiness.fi, http://www.healthcarebusiness.fi, http://www.learningbusiness.fi and http://www.swbusiness.fi and to all web pages linked to them (hereinafter referred to as the “Site”). By using the Site the user of the Site (hereinafter referred to as the “User”) agrees to be bound by the Terms of Use and undertakes to comply with the Terms of Use while using or otherwise utilising the Site.

The contentbusiness.fi site is a meeting point, databank and a news source for content providers, the healthcarebusiness.fi site for medical and welfare technology companies and service providers, the learningbusiness.fi site for companies within the digital learning business and the swbusiness.fi site for software product companies and for the interest groups of the clusters of these companies. The Site is intended to be used for purposes related to the areas of business mentioned above and the Site may be used for these purposes only. All enquiries concerning the Site or these Terms of Use should be directed to Culminatum via e-mail at culminatum@culminatum.fi.

2. Intellectual Property Rights

All articles, publications and other material on the Site are protected under copyright laws. Copying, publication and other use thereof for non-commercial purposes only is permitted on the condition that the source is acknowledged. Any copying or quotation for commercial purposes is prohibited.

All trade names, trademarks and service marks of products and services appearing on the Site are protected trade names, trademarks and service marks of their respective owners. All usage thereof is prohibited without permission of the company in question.

All intellectual property rights related to software located at the Site are the property of Culminatum or its licensor. The licence terms of the software referred to will be applied to the use of the software.

3. Use of the Site

In order to register for the Site the User will create a user name and a password. The password is personal and the User undertakes to keep it with care and not to disclose it to a third party. The User will be responsible for all use of the Site that occurs under his/her user name and password .

All Users and other parties (hereinafter referred to as “Content Providers”) may provide the Site with works, information or other material or content (hereinafter referred to as “the Content”) so that all the users of the Site would get as current and versatile material and information as possible by using the Site. The Content Provider will be responsible for all Content placed by it. Culminatum has no possibility to review the Content before or after the Content is provided. Culminatum will use reasonable efforts to exclude all unlawful, offensive, indecent, abusive, violation or incorrect material immediately after receiving notice of the existence of such Content.

The Site uses cookies to provide faster use of the Site for the Users. The User may prevent the use of the cookies by changing settings of his/her browser. The prevention of the cookies can slow down the loading of the Site and prevent the use of certain parts of the Site.

Culminatum has the right to modify the Site’s appearance, structure, Content or other material at any time without notifying the Users or the Content Providers in advance and prevent access to the Site partly or wholly due to technical reasons. Culminatum will endeavour to give advance notice of the interruptions.

4. Content provided by a Content Provider

The Content Provider represents and warrants:

• to comply with these Terms of Use and not to use the Site for unlawful or indecent purposes or for purposes contrary to good business practice such as chain mail or messages, mass e-mail sending (spamming) or for other such purposes;
• not to use fake identification or e-mail addresses and nor otherwise give misleading information about his/her identity or origin of a message;
• not to provide Content to the Site without ensuring that the Content will not contain computer viruses or other such software programs;
• not to provide Content that:
  • does not comply with the purpose of the Site specified in section 1 above;
  • infringes copyrights or other intellectual property rights of a third party;
  • infringes otherwise a right of a third party or is otherwise indecent, includes inappropriate material or is otherwise unlawful, inappropriate or offensive to someone
  • not to try to prevent or hinder the use of the Site by other users.

The Content Provider grants to Culminatum a royalty-free and perpetual right to use, publish, copy, reproduce and distribute any Content placed by it on the Site. The right of use of Culminatum contains also the right to change, develop and translate the Content provided by the Content Provider and to use it within the right of use stated above. However, copyright to the Content is retained by the Content Provider .

Culminatum has the right, but not the obligation, to monitor the Content on the Site. Culminatum has the right to remove or replace any Content on the Site at any time or to comment it without notifying the Content Provider in advance thereof, if

• Culminatum in it’s sole discretion deems it to be unlawful or against these Terms of Use or if a third party presents such a claim;
• Culminatum has a reason to suspect that the Content infringes otherwise a right of a third party; or
• Culminatum in it’s sole discretion deems that the Content is incorrect, misleading, out-of-date or in violation of good business practices

Culminatum has also the right to remove Content provided by a Content Provider without further notice after fourteen (14) months have passed since from the delivery or last update of the Content and the Content Provider has despite a reminder by Culminatum failed to remove or update the Content. Culminatum has the right to remove Content Provider’s e-mail messages at any time without notice.

5. Links to E-Commerce Sites and to Other Websites and Limitation of Liability

The Site contains hyperlinks to electronic commerce sites and to other websites (hereinafter referred together as the “Third-Party Sites”). The User is aware that these Third-Party Sites are not maintained by Culminatum and that Culminatum does not actively monitor the content of these Third-Party Sites. The User acknowledges that Culminatum is not liable for any information on the Third-Party Sites or the content thereof nor liable for commodities marketed or offered on these Third-Party Sites.

The User acknowledges that when ordering products or services from the Third-Party Sites the User is entering into an agreement with the maintainer of the Third-Party Site in question. The User acknowledges that Culminatum has no liability for any order made using the Third-Party Sites and that Culminatum is in no other way liable for actions of the maintainer of Third-Party Site. The User must direct all enquiries and claims related to a product and service ordered using the Third-Party Site directly to the maintainer of the site in question.

6. Transfer of Personal Data

The User gives Culminatum his/her unambiguous consent to process personal or company data given by the User for cluster publications, direct marketing, opinion polls and market research and for other comparable addressed deliveries concerning the clusters involved .

Culminatum has the right to transfer personal data of the User for above stated purposes both in Finland and globally provided, that the User has not prohibited this when registering himself/herself as a user of the Site or later by a written notifice.

7. Limitations of Liability

Culminatum shall not be liable for any damages caused due to events outside its reasonable control (force majeure). Culminatum is not liable for interruptions in the use of the Site or for any other restrictions or disturbances in the use of the Site or for the qualitative aspects of the Site or for its suitability for a specific purpose.

In addition to what has been stated otherwise in these Terms of Use, Culminatum shall not be liable for any possible damages caused to a Content Provider or a User. Under no circumstances shall Culminatum be liable for any indirect damages.

These Terms of Use are valid until further notice. Culminatum has the right to amend these Terms of Use at any time with immediate effect by posting a notice on the Site or by sending a notification to the e-mail address provided by the User at the time of registration. The User is deemed to have approved the amendments if he/she uses the Site after the notification.

Culminatum has the right to remove the Users right of use and access to the Site with immediate effect if the User is in violation of these Terms of Use.

9. Applicable Law and Settlement of Disputes

These Terms of Use shall be governed by the laws of Finland. Any disputes arising in connection with these Terms of Use shall be resolved in the district court of Espoo (Espoon käräjäoikeus).
